Acceptable Use & Abuse Policy
Rules designed to protect ESM customers, infrastructure, IPv4 reputation, networks, upstream providers, and third parties from abusive or malicious use.
Plain-English note: These public terms are written to explain ESM's operating and commercial expectations clearly. Service-specific order forms, invoices, statements of work, signed agreements, and rights that cannot legally be excluded may also apply.
Acceptable Use & Abuse Policy
This Acceptable Use & Abuse Policy ("AUP") applies to all eLite Server Management services, including hosting accounts, VPS, Dedicated Servers, IPv4 addresses and subnets, managed services, backup services, migrations, monitoring, and network resources.
The purpose is to protect customers, networks, IP reputation, data-center and carrier relationships, and third parties from unlawful, abusive, malicious, or excessively disruptive activity.
1. Scope
This Policy applies to Customers and to all employees, contractors, resellers, clients, end users, applications, websites, scripts, virtual machines, devices, and systems using resources associated with the Customer's ESM account.
2. General Prohibited Use
Customers may not use ESM services to violate law, facilitate crime, interfere with networks or systems, deceive users, distribute malicious software, send unauthorized bulk messages, conduct unauthorized access, evade provider restrictions, or materially harm ESM, its suppliers, other customers, or third parties.
3. Spam, Unsolicited Messaging & Mail Abuse
Spam, unsolicited bulk email, snowshoe mailing, purchased-list blasting, address harvesting, mail-bombing, forged mail headers, deceptive opt-in practices, and repeated sending to recipients who have not provided appropriate permission are prohibited.
Customers operating legitimate mail services must maintain appropriate consent records, unsubscribe processes where applicable, complaint handling, bounce management, authentication, and reasonable reputation practices.
4. Phishing, Credential Theft & Fraud
Phishing pages, fake login portals, credential collection, impersonation, payment fraud, scam operations, identity theft, deceptive domains, fraudulent support activity, and services designed to facilitate such conduct are prohibited.
5. Malware, Botnets & Malicious Code
Malware distribution, ransomware, command-and-control systems, botnets, cryptominers deployed without authorization, malicious loaders, credential stealers, exploit kits, backdoors, or systems intentionally supporting malicious campaigns are prohibited.
6. Network Attacks & Unauthorized Access
Customers may not launch or facilitate DDoS attacks, packet floods, reflection/amplification attacks, brute-force attacks, unauthorized vulnerability scanning, credential stuffing, port scanning against third parties without authorization, exploitation, spoofing, route hijacking, or attempts to bypass access controls.
7. IPv4 Reputation & Address-Space Abuse
ESM IPv4 resources may not be used for spam, blacklist evasion, rapid reputation cycling, snowshoe operations, deceptive mail infrastructure, phishing, malware, botnets, proxy abuse, unauthorized BGP announcements, source-address spoofing, or other activity that materially damages address reputation or upstream relationships.
Repeated reputation incidents may result in null-routing, withdrawal of an address or subnet, suspension, or termination. Refunds are not available for IPv4 services suspended or terminated for abuse.
8. Illegal, Exploitative or Harmful Content
Content or services that are unlawful in the applicable jurisdiction, facilitate serious wrongdoing, exploit minors, distribute non-consensual intimate material, promote fraud, or directly facilitate violent criminal activity are prohibited. ESM may act on valid legal orders and credible urgent safety reports.
9. Copyright, Trademark & Intellectual Property
Customers must respect applicable intellectual-property rights. ESM may process sufficiently complete infringement notices and may restrict or remove material when legally required. Repeat infringement may result in service restriction or termination.
10. Proxy, VPN, Relay & Anonymization Abuse
Proxy, VPN, tunneling, relay, scraping, or automation workloads must not be used to facilitate credential abuse, spam, fraud, attacks, evasion of third-party access controls, or unlawful activity. ESM may require additional verification or restrict services that create disproportionate abuse or reputation risk.
11. Compromised Systems
Customers are responsible for compromised websites, accounts, servers, scripts, plugins, credentials, or applications under their control even when abuse was not intentional. ESM may temporarily isolate, disable mail, block ports, suspend, or null-route compromised systems until the risk is contained.
12. Resource & Platform Abuse
Customers may not intentionally exhaust shared resources, bypass plan restrictions, operate workloads that materially degrade other customers, abuse backup systems as general-purpose archival storage contrary to plan terms, or interfere with platform monitoring and security controls.
13. Reporting Abuse
Abuse reports should include affected IP addresses or domains, timestamps with timezone where possible, log excerpts, message headers for email incidents, URLs, screenshots, and a clear description of the observed activity. Incomplete reports may require additional information before action can be taken.
14. Investigation & Remediation
ESM may review logs, contact the Customer, request remediation, require password changes, restrict ports or mail, remove routing, involve upstream providers, preserve evidence, or take other proportionate measures. Response time depends on severity, evidence, active risk, supplier requirements, and Customer cooperation.
15. Emergency Suspension & Protective Action
ESM may take immediate action without prior notice where necessary to stop active phishing, malware, attacks, spam outbreaks, compromised infrastructure, legal violations, or material threats to network stability, IP reputation, or third parties.
16. Repeat Abuse & Failure to Cooperate
Repeated complaints, repeated compromise caused by unresolved security weaknesses, failure to respond to abuse notices, or failure to complete reasonable remediation may result in stronger restrictions or termination. ESM is not required to repeatedly restore a service that continues to create material risk.
17. Law Enforcement, Court Orders & Provider Requirements
ESM may respond to valid legal process and may take action required by data centers, carriers, registries, network providers, or other suppliers where necessary to maintain infrastructure or comply with their rules, subject to applicable law.
18. Customer Responsibility
Customers must maintain secure credentials, patched software, appropriate access controls, lawful content, monitored mail activity, and reasonable oversight of users or clients to whom they provide access. Resellers remain responsible for abuse generated by downstream customers using ESM resources.
19. Contact & Abuse Reporting
Report abuse using ESM's Contact page or authenticated support channels. For active incidents, include the relevant service, IP or domain, timestamps, evidence, and a reliable contact address. General support requests should use the Support Center.
